About these terms
These terms explain the permitted use of phtm.ch, the website of Phantom Consulting, based in Vaud, Switzerland and presented under the PHTM Consulting name. Contact us at contact@phtm.ch. Please read these terms before using the website.
The website describes business consulting and done-for-you systems work. It is intended to help businesses understand our services and decide whether to contact us. It is not an online checkout or a client services agreement.
Enquiries and client engagements
Sending an enquiry, discussing a project or reading a service description does not by itself create a client engagement or oblige either party to proceed. We assess fit and agree the work in a separate written agreement.
That agreement should set out the scope, fees, payment terms, timing, responsibilities, confidentiality, data handling, intellectual property arrangements and termination rights for the engagement. Where it conflicts with these website terms on a service-related matter, the engagement agreement takes precedence, subject to applicable law.
Statements on the website about systems, documentation and handover describe our approach. The deliverables and rights for a particular project are those agreed in writing.
Website information and results
Website content is general information about our work. It is not advice tailored to your business or a substitute for an assessment of your circumstances. Obtain appropriate professional advice before making decisions that require it.
Published results describe particular client experiences. Each result comes from a different business unless expressly stated otherwise. They do not guarantee that another business will achieve the same or similar outcome. Results depend on factors including the starting position, implementation, team and market conditions.
We aim to keep information accurate and current, but errors or omissions may occur. Please contact us if you spot one or need to confirm a detail before relying on it.
Permitted use
You may browse the website and use its information to evaluate our services. You must not:
- Use it for unlawful, fraudulent or misleading purposes, or impersonate another person or business.
- Attempt unauthorised access to systems or information, introduce malicious code, or disrupt or overload the website.
- Use contact channels for spam, harassment or material you do not have the right to share.
- Copy or exploit website content commercially beyond the permissions below or what applicable law allows.
Website content and intellectual property
Rights in the website's original text, visual design and other materials belong to their respective owners. Visiting the website does not transfer ownership or grant rights in PHTM's brand or project materials.
You may save or print reasonable extracts for internal business evaluation, provided you retain relevant attribution, do not misrepresent the material and do not sell or republish it commercially without permission. Rights available under applicable law are unaffected.
Ownership and licensing of work delivered to a client are governed by the separate engagement agreement, not this website-content clause.
Availability and external links
We may maintain, change or withdraw parts of the website. We do not promise uninterrupted access or that the website will always be error-free. Changes to the website do not amend an existing client agreement.
External links, including LinkedIn, lead to services outside our control. Their content, availability and terms are their operators' responsibility. A link does not imply endorsement of everything on the destination website.
Responsibility and your legal rights
Responsibility for any loss arising from use of the website is determined under applicable law. We do not make a promise of a particular business outcome through the website.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot lawfully be limited, or any other liability that applicable law does not permit us to exclude or limit. Nothing removes mandatory rights you may have.
These terms do not impose a separate liability cap or replace the responsibility and liability provisions agreed for a client engagement.
Personal information
Our privacy policy explains how personal information associated with website visits and correspondence is handled. Reading these terms does not give consent to optional tracking or marketing.
Changes, applicable law and contact
We may update these website terms by publishing a revised version with a new date. Changes apply to future use and do not retrospectively change an existing engagement agreement.
These website terms are governed by Swiss law, subject to any mandatory rights that apply. They do not select an exclusive court or remove any jurisdiction or rights that mandatory law provides.
For questions about these terms, use the privacy and legal contact in the business details above.
